Emech warrants its products against defects in materials and workmanship. The term of this warranty is 12 months from date of commissioning. This is a parts only warranty. The owner is responsible for disassembling, reassembling and reinstalling the Emech product.

To facilitate the handling of warranty claims, Emech has instituted an Express Service Policy. To make a warranty claim, contact Emech and request an Express Service Code (ESC). Emech shall issue the ESC and instruct the owner where to send the product. Where appropriate, Emech may instruct the owner to send the product to one of Emech’s authorised agents. The product should be securely packaged and sent free of any attachments (e.g. couplings, brackets and mounting fittings). The packaging should clearly show the ESC issued by Emech. Along with the product returned, the owner should include a detailed explanation of the defect along with proof of purchase (if requested).

Emech shall notify the owner if Emech does not receive the product within a reasonable time after issuing the ESC. Emech shall use its reasonable efforts to repair or replace the product within two business days following receipt. Emech shall notify the owner in the event of any delays beyond Emech’s control.

The owner shall bear the freight cost to ship the product to Emech or its authorised agent. Emech shall bear the freight cost to ship the product back to the owner. Emech shall include a brief description of the repairs made, including a list of parts replaced and/o recalibrated.

Emech shall fairly evaluate a warranty claim. If Emech accepts the claim, it will either repair or replace the product as it may determine in its sole discretion. If for any reason Emech does not wish to repair or replace the product, it shall refund the purchase price. Emech’s liability shall not exceed the purchase price of the product.

Emech’s sole responsibility is to repair or replace a product that is the subject of a valid warranty claim. Under no circumstance will Emech be liable for direct, indirect, incidental, special or consequential costs or damages, including dismantling and reinstallation costs, loss of production or profits resulting from downtime.

This warranty is void in any of the following circumstances: (a) The product has been misused, mishandled, neglected, abused or damaged, including water damage to an actuator. (b) The product has been incorrectly wired, aligned or calibrated. (c) The product
is not suitable for the owner’s application. (d) The product has been improperly installed, operated, repaired, adjusted, serviced or maintained. (e) The product has been modified. (f) The product has been connected to other equipment with which it is not compatible. (g) The product has been used outside its stated specifications and operating parameters, including specifications and operating parameters relating to capacity, duty cycle, temperature and pressure. (h) The product has been used for purposes other than for which it was designed.

If the product is off-warranty or otherwise not subject to a valid warranty claim, Emech will repair or replace the product at the owner’s cost. Refer to Emech’s website or contact Emech for details about its Express Service Policy.

Many factors can cause an Emech product not to function properly. Such factors may have nothing to do with a product fault. Before making a warranty claim, the owner should make sure that the product is truly defective. That is to say, the owner should have followed standard trouble shooting and fault finding procedures and attributed the problem to a fault in the product. Refer to Emech’s technical documentation on its website. If necessary, contact Emech for technical support. If Emech determines that a returned product was not defective, or that the warranty claim was otherwise not valid, Emech shall charge the owner a handling and servicing fee as well as the freight cost.

This warranty applies to Emech’s products. It does not apply to ancillary equipment over which Emech has no control. Such ancillary equipment includes, without limitation, electrical equipment, plumbing equipment, power generation equipment, pipes, hoses and fittings.

Emech’s products are capable of being used in many different types of industrial applications and operating environments. Therefore, proper selection of a specific product for a specific application and operating environment, and its compatibility with other equipment to which it is attached, is the owner’s responsibility. The owner must assume the ultimate responsibility for the proper sizing, selection, compatibility, installation and operation of Emech products. All operating parameters should be validated for the owner’s application by a professional engineer, qualified installer or by another technical expert. Emech does not warrant the performance of its products or their suitability for a particular purpose. It is the owner’s responsibility to determine the suitability of the products for the owner’s use.

Installation is entirely at the owner’s risk. Emech products should be installed by qualified technicians only. Emech accepts no liability for damages resulting from faulty installation.

Emech accepts no liability for direct, indirect, incidental, special, or consequential damages resulting from the owner’s failure to follow Emech’s warnings, instructions and procedures or such other procedures generally applicable to equipment of the same type. The foregoing limitation extends to damages to person or property as well as loss of profits, loss of products, loss of operations, the cost of alternative arrangements and loss of time, whether incurred by the owner, its employees or a third party.

This is an express warranty. Emech disclaims any other express or implied warranties, including warranties of merchantability or fitness for purpose, to the maximum extent permitted by law.

Some jurisdictions do not allow limitations or disclaimers of implied or statutory warranties. Some jurisdictions do not allow disclaimers or exclusions of consequential or incidental damages. Therefore, the above disclaimers, limitations and exclusions may not apply in all jurisdictions in which Emech sells its products.

This warranty gives the owner specific legal rights. The owner may have other rights or remedies pursuant to the laws in its territory. Nothing in this limited warranty should be construed as limiting or restricting any other statutory right or remedy of the owner, except for such limitations or restrictions herein as may be allowed by the law of the territory.
